Terms of Service

Effective date: July 14, 2026

1. Agreement to Terms

By using FlexCut3D's parametric laser-cutting design software and model store (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

FlexCut3D is a web-based 3D CAD application for parametric modeling and laser-cutting workflows. The Service includes design tools, SVG import/export, 2D layout tools, AI-assisted features, cloud project storage, and a store of ready-made parametric models ("Store").

3. Account Registration

To use the Service you must:

  • Be at least 13 years old
  • Provide accurate registration information
  • Keep login credentials confidential
  • Be responsible for all activity under your account

4. Purchases, Credits and Payment

  • All payments are processed by Paddle, our merchant of record. Paddle handles billing, applicable taxes, receipts, and refunds under its own terms.
  • Store purchases are one-time payments that grant you a license to the purchased model (see Section 7 and our License Terms). Purchased models remain re-downloadable from your account.
  • PTS credits are an optional in-app currency used for AI-powered features. Credits are consumed on use, are non-refundable once spent, and have no cash value.
  • Prices may change at any time; changes never affect what you have already bought.
  • Refunds for Store purchases are handled per our Refund Policy.

5. AI Services

  • Certain features use AI credits (PTS)
  • AI-generated content is provided "as is" — you are responsible for reviewing and validating AI outputs before use

6. Your Content and Ownership

Your designs. You retain full ownership of all CAD projects, parametric models, SVG files, and designs you create yourself using FlexCut3D ("User Content"). FlexCut3D does not claim ownership of User Content. You grant us a limited, non-exclusive, revocable license to store, process, and display your User Content solely to provide the Service.

7. Designs You Create vs. Models You Purchase (IMPORTANT)

Designs you create yourself: commercial use is explicitly allowed. You may sell physical products made from your own FlexCut3D designs, sell or license your own exported files, and use your designs for freelance, business, or client work. No royalties are owed to FlexCut3D.

Models you purchase from the Store: these are licensed, not sold. Every Store Model is licensed under our single Standard License — see the full License Terms. You may make and sell the physical items you produce from a purchased Model (including for commercial and client work), but you may NOT resell, share, or redistribute the purchased template file itself, publish it (modified or not) as your own template, or use it to create a competing template product.

8. Platform Intellectual Property

All software, internal file formats, parametric systems, AI systems, UI/UX, branding, logos, documentation, and Store-listed models are the intellectual property of FlexCut3D or its licensors. These Terms do not grant you ownership of FlexCut3D technology or Store models.

9. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or extract source code
  • Modify, decrypt, or tamper with FlexCut3D project files outside the Service
  • Share, resell, or redistribute purchased Store files
  • Bypass purchase checks, download restrictions, or AI credit systems
  • Use bots, scrapers, or automated systems
  • Share accounts or credentials
  • Interfere with system performance or security
  • Use the Service for illegal or harmful purposes

Violations may result in immediate suspension or termination, including revocation of Store download access.

10. Manufacturing and Laser-Cutting Disclaimer

FlexCut3D provides design software and design files only. You are solely responsible for verifying dimensions, tolerances, and material suitability; testing designs before production; and the safe operation of laser-cutting equipment. FlexCut3D is not liable for manufacturing errors, material loss, equipment damage, or personal injury.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Maintenance, updates, or outages may occur.

12. Termination

You may stop using the Service at any time. We may suspend or terminate accounts for violations of these Terms. Where reasonably possible, access to already-purchased Store models will be preserved unless the account was terminated for license abuse or fraud.

13. Limitation of Liability

To the maximum extent permitted by law: the Service is provided "as is"; we are not liable for indirect or consequential damages; and our total liability is limited to the fees you paid us in the last 12 months.

14. Indemnification

You agree to indemnify and hold harmless FlexCut3D from claims arising from your designs or products, your use of the Service, or your violation of laws or third-party rights.

15. Privacy

Use of the Service is subject to our Privacy Policy.

16. Changes to Terms

We may update these Terms. Continued use after updates constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the Republic of Suriname, without regard to conflict-of-law principles. Payment-related matters are additionally subject to Paddle's terms as merchant of record.
